Short description of speciality
ADR (hereinafter referred to as the "ADR") formally the Agreement of 30 September 1957 concerning the International Carriage of Dangerous Goods by Road, is a 1957 United Nations treaty that governs transnational transport of hazardous materials. "ADR" is derived from the French name for the treaty: Accord relatif au transport international des marchandises Dangereuses par Route). Until 31 December 2020, the treaty was fully named European Agreement concerning the International Carriage of Dangerous Goods by Road. However, as the word "European" might have given the impression that the treaty was only open for accession to European states, an amendment was decided in the end of 2019. Protocol amending the title of the European Agreement of 30 September 1957 concerning the International Carriage of Dangerous Goods by Road (ADR) entered into force for all the Contracting Parties on 1 January 2021. The Government this amendment enacted in the Hungarian legislation with the No. 508/2020. (XI. 18.) Government Decree and entered into force on 1 January 2021.
RID (hereinafter referred to as the "RID") shall mean the Regulations concerning the International Carriage of Dangerous Goods by Rail, appearing as Appendix C to the Convention concerning International Carriage by Rail (COTIF) concluded at Vilnius on 3 June 1999, as amended. RID was promulgated by the Legislative Decree No. 2 of 1986.;
ADN (hereinafter referred to as the “ADN”) shall mean the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways, concluded at Geneva on 26 May 2000, as amended. ADN was promulgated by the No. III. of 2009. Hungarian law.
The Ministerial decree 29/2011. (VIII. 3.) NGM on safety requirements and certification of conformity of the transportable pressure equipments transposing in to Hungarian legislation requirements concerning Directive 2010/35/EU of the European Parliament and of the Council of 16 June 2010 on transportable pressure equipment and repealing Council Directives 76/767/EEC, 84/525/EEC, 84/526/EEC, 84/527/EEC and 1999/36/EC. This decree defines the scope of transportable pressure equipment.
Transportable pressure equipment means: all pressure receptacles, their valves and other accessories when appropriate, for the transport of ADR, RID, ADN Class 2 gases, excluding gases or articles with figures 6 and 7 in the classification code, and for the transport of the dangerous substances of other classes specified in Annex I of Directive 2008/68/EC including gas cartridges (UN No 2037) wich are conform to Chapter 6.2 of ADR, RID, and ADN; tanks, battery vehicles/wagons, multiple-element gas containers (MEGCs), their valves and other accessories when appropriate, wich are conform to Chapter 6.8 of ADR, RID, and ADN.
Transportable pressure equipment excluding aerosols (UN No 1950), open cryogenic receptacles, gas cylinders for breathing apparatus, fire extinguishers (UN No 1044).
„Pi marking” means a marking which indicates that the transportable pressure equipment is in conformity with the applicable conformity assessment requirements set out in ADR, RID, and ADN and Directive 2010/35/EU.
The Ministerial decree 29/2011. (VIII. 3.) NGM shall apply to:
a) new transportable pressure equipment, which does not bear the conformity markings, for the purpose of making it available on the market;
b) transportable pressure equipment bearing the conformity markings for the purposes of its periodic inspections, intermediate inspections, exceptional checks and use;
c) transportable pressure equipment as defined in Article 2(1), which does not bear the conformity markings, for the purposes of reassessment of conformity.
The Ministerial decree 29/2011. (VIII. 3.) NGM shall not apply to:
a) to transportable pressure equipment which was placed on the market before the date of 1 th of May 2004. and which has not been subject to a reassessment of conformity.
b) to transportable pressure equipment used exclusively for the transport of dangerous goods between Member States and third countries, carried out in accordance with ADR, RID, and ADN.
