Certification of undertakings

The Government Office of the Capital City Budapest, Unit of Defence Industry (hereinafter referred to as "Authority") issues certificates in accordance with the Directive 2009/43/EC of the European Parliament and of the Council of 6 May 2009 simplifying terms and conditions of transfers of defence-related products within the Community and with Commission Recommendation 2011/24/EU of 11 January 2011 on the certification of defence undertakings under Article 9 of Directive 2009/43/EC of the European Parliament and of the Council simplifying terms and conditions of transfers of defence-related  products within the Community

Application for certifiction has to be submitted using the standard form pescribed by the Authority, which can be downloaded here.

According to the Government Decree 156/2017 in the course of the certification procedure the Authority examines the reliability of the undertaking. An undertaking is reliable if:

 (a)        It has had activity licence for foreign trade of military equipments as per Government Decree 156/2017 and  activity licence for production of military equipments as per Act CIX of 2005, both valid at least since two years.         

(b)       It has fully complied with the legislative provisions of  Act CIX of 2005 on licensing the manufacture of military equipment and provision of military technical services, as well of the Government Decree 156/2017 on licensing the export, import, transfer and transit of military equipments, military services and certification of undertakings and the provisions of  the undertaking’s internal compliance programme.

(c)        The competent senior executive appointed in the internal compliance programme gives a written declaration that the company will take all necessary steps to observe and enforce all specific conditions related to the end-use and export of any specific component or product received,

(d)       The competent senior executive appointed in the internal compliance programme gives a written undertaking to provide to the competent authorities, with due diligence, detailed information in response to requests and inquiries concerning the end-users or end-use of all products exported, transferred or received under a transfer licence from another Member State; and 

(e)        The competent senior executive appointed in the internal compliance programme declares in writing that the received military equipment will be used for the undertaking's own manufacturing purposes and activities.

Undertakings certified by the Authority are allowed to receive military equipment specified in its certificate and shipped under a general transfer licence.

The certificate can be issued for military equipment and the use of services which are necessary for the undertaking's manufacturing activities.

Member States of the European Union recognise any certificates issued in accordance with the Directive 2009/43/EC in another Member State.

The certification is valid for 5 years. The deadline for evaluation of an application for certification is 90 days.

The Authority monitors the compliance of the certified company with the criteria described in the Gov. Decree 156/2017  at least every three years in form of an on-site control.

The Authority publishes and regularly updates the list of Hungarian certified companies on his own website and on by the European Commission supported CERTIDER on Europa website.
