The Official Journal of the EU (L 165) published REGULATION (EU) 2023/1230 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 14 June 2023 on machinery and repealing Directive 2006/42/EC of the European Parliament and of the Council and Council Directive 73/361/EEC.

Short description of speciality

These products are determined by the ministerial decree 16/2008. (VIII.30.) NFGM rendelet (hereafter: Decree). Directive 2006/42/EC is transposed to Hungarian law by Decree.

Definition of machinery is: an assembly, fitted with or intended to be fitted with a drive system other than directly applied human or animal effort, consisting of linked parts or components, at least one of which moves, and which are joined together for a specific application.
The partly completed machinery is also under the scope of Decree. Partly completed machinery is only intended to be incorporated into or assembled with other machinery or other partly completed machinery or equipment, thereby forming machinery.

From the above description it can be seen that most equipment driven by external power is under the group of machines. Of course there are many exceptions, like e.g. motor vehicles, means of transport by air, on water and on rail networks (with the exclusion of machinery mounted on these means of transport, vehicles), specific equipment for use in fairgrounds and/or amusement parks, machinery specially designed and constructed for military or police purposes, machinery intended to move performers during artistic performances, motor vehicles exclusively intended for competition, many electrical and electronic equipments. Safety of these products are determined by other directives.

Interchangeable equipments, safety components, lifting accessories, chains, ropes and webbing, removable mechanical transmission devices or lifting machinery only powered by directly human effort are also under the scope of Decree.

It is important to notice that the conformity assessment is the internal control of production in the case of most machines. There are such categories of machineries  of which use is more dangerous for health of human, so the conformity assessment of these machineries are more stringent, for example EC type-examination should be applied.  These machineries are e.g.  hand-fed machinery for woodworking, for working with meat or for injection or compression plastics. Notified bodies (external, specialized bodies) must be involved in conformity assessment of the machineries in cases determined by Decree. Notified body attests the type of product (EC type-examination) or supervises the production (full quality assurance). In these cases the safety of the product is guaranteed only together EC conformity of declaration and certificate (for example EC type-examination) issued by the notified body.

Short description of speciality

These products are determined by the governmental decree 140/2001. (VIII. 8.) Korm. rendelet (hereafter: Gov. decree). Directive 2000/14/EC is transposed to Hungarian law by the Gov. decree and the 29/2001. (XII.23.) KöM-GM joint decree.

These products are (not total listing):

  • builders' hoists for the transport of goods (combustion-engine driven),

  • compaction machines,

  • compressors,

  • concrete-breakers and picks, hand-held,

  • construction winches,

  • dozers,

  • dumpers,

  • excavator-loaders,

  • lift trucks,

  • loaders,

  • brush cutters,

  • lawnmowers,

  • motor hoes.

Within the framework of the internal market, requirements for the noise emission by equipment for use outdoors have to be harmonised in order to prevent obstacles to the free movement of such equipment. Reducing permissible noise levels for such equipment will protect the health and well-being of citizens as well as protect the environment. The public should also be provided with information on the noise emitted by such equipment.

The manufacturer, or his authorised representative established in the European Economic Area, of equipment shall, in order to certify that an item of equipment is in conformity with the provisions of Gov. decree, draw up an EC declaration of conformity for each type of equipment manufactured. The EC declaration of conformity should be written in Hungarian language. If the EC declaration of conformity is not written in Hungarian, the translation must be done.

Before placing on the market or putting into service any equipment subject to noise limits the manufacturer, or his authorised representative established in the European Economic Area, shall subject each type of equipment to one of the following conformity assessment procedures:
a)      internal control of production with assessment of technical documentation and periodical checking procedure , or

b)      unit verification procedure, or

c)      full quality assurance procedure.

The guaranteed sound power level of equipment with no noise limits shall be subject to noise marking only.
